Terms of Service

These Terms of Service ("Terms") govern your access to and use of the MyNumber mobile application and website at mynumberiq.net (together, the "Service"). The Service is operated by MyNumber ("we", "our", "us") and lets users in Iraq list, browse, buy, and sell phone numbers and vehicle license plates.

By creating an account or otherwise using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to use the Service. By using the Service you confirm that you meet these requirements.

2. Your Account

• You agree to provide accurate, current, and complete information when you register and to keep that information up to date.
• You are responsible for keeping your password and other authentication credentials confidential. Activity that occurs under your account is your responsibility.
• Notify us promptly at support@mynumberiq.net if you suspect unauthorised access to your account.
• We may refuse, suspend, or terminate any account at our discretion, in particular for violations of these Terms.

3. Listings and User Content

"User Content" means anything you submit to the Service, including listings, images, descriptions, prices, messages, and profile information.

• You retain ownership of your User Content. You grant MyNumber a worldwide, royalty-free licence to host, store, display, reproduce, modify (for formatting only), and distribute it for the purpose of operating and promoting the Service.
• You warrant that you have the legal right to sell anything you list and that your User Content does not infringe any third-party rights.
• You must not list anything that is illegal under Iraqi law, stolen, counterfeit, or that you do not own or have the right to transfer.
• We may remove or refuse to publish any User Content at our discretion, in particular if it appears to violate these Terms or applicable law.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or to facilitate fraud.
• List counterfeit, stolen, or otherwise unlawfully obtained items.
• Impersonate any person or misrepresent your affiliation with any person or entity.
• Harass, threaten, intimidate, or send unwanted communications to other users.
• Post spam, repetitive listings, misleading prices, or advertisements for other platforms.
• Attempt to gain unauthorised access to the Service, other users' accounts, or our systems.
• Scrape, crawl, or otherwise extract data from the Service in bulk, except as permitted by our robots.txt and API terms.
• Reverse-engineer, decompile, or attempt to derive source code from the Service.
• Use any automated means (bots, scripts) to interact with the Service except through interfaces we explicitly provide.

5. Marketplace Conduct

MyNumber is a venue. We provide a platform that lets buyers and sellers find each other. We are not a party to any transaction between users, do not pre-screen User Content, do not verify the authenticity or legality of listed items, and do not guarantee that any transaction will be completed.

• Sellers are responsible for describing items accurately, honouring their listings, complying with applicable taxes, and completing transfers as agreed.
• Buyers are responsible for verifying the legitimacy of listings before paying, taking reasonable precautions when meeting sellers, and understanding the legal requirements for the items they are buying.
• Disputes between users are between those users. We may, but are not obligated to, help mediate.

6. Payments

MyNumber does not currently process payments between buyers and sellers. Payment arrangements are made directly between the parties, off-platform. We are not responsible for payment collection, refunds, or chargebacks. If we add payment processing in the future, additional terms will apply.

7. Intellectual Property

The Service itself, including its design, code, name, logo, and content not submitted by users, is owned by MyNumber or our licensors and is protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works of the Service without our written permission.

8. Termination

You may stop using the Service and delete your account at any time through Settings → Delete Account.

We may suspend or terminate your access to the Service at any time, with or without notice, in particular if we believe you have violated these Terms, posed a risk to other users, or otherwise misused the Service. Sections that by their nature should survive termination (including 7, 9, 10, 11, and 13) will survive.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. To the maximum extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, and continuous availability.

We do not warrant that listings are accurate, that sellers will deliver items, that buyers will pay, or that any transaction initiated on the Service will be completed.

10. Limitation of Liability

To the maximum extent permitted by law, MyNumber and its officers, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or opportunity, arising out of or relating to your use of the Service, even if advised of the possibility of such damages.

Our total cumulative liability arising out of or relating to the Service will not exceed the greater of (a) the amount you have paid us in the 12 months preceding the claim or (b) USD 100.

11. Indemnification

You agree to indemnify and hold MyNumber harmless from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to your User Content, your use of the Service, or your violation of these Terms.

12. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Iraq, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the competent courts located in Iraq, and you consent to their jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified in-app or by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

14. Severability

If any provision of these Terms is held to be unenforceable, the remaining provisions will remain in full force and effect.
